The Supreme Court on Thursday dismissed a plea filed by former Maharashtra home minister Anil Deshmukh, challenging the Bombay High Court order directing a CBI investigation into the charges. The Apex Court also dismissed a similar plea filed by the Maharashtra government. Delivering its order, the Supreme Court said the people involved in the matter do require to be investigated by an independent agency. "What has been directed by the high court is a preliminary inquiry, and we are not inclined to interfere," the court said.
A bench of Justices S K Kaul and Hemant Gupta said that Anil Deshmukh did not resign initially (following the allegations being made public). He did so only after the High Court directed a probe. It means the Home Minister was clinging on to office," the top court said, highlighting that allegations were made by a person who was the minister's right-hand person.
Appearing for him, senior advocate Kapil Sibal said anyone could make any allegation. "I am not saying there should be no preliminary probe. But get my version on record and decide. Do not bring an outside agency, there are problems. I am vilified without being given chance. Look at the damage it has caused." When the court asked if an accused could choose the probing agency, Deshmukh said he was neither an accused nor a suspect."It is a hearsay statement with no material (evidence). The man, Waze, tells another person and that person tells Bhujbal, and he in turn tells the police commissioner. The commissioner makes the statement after he is shifted out of the position," Deshmukh argued.
Meanwhile, The BJP has accused the Maharashtra's government of promoting corruption in the State with the help of police. The party has said, corruption has become the identity of the Maha Vikas Aghadi led government. Briefing reporters in New Delhi on Thursday, Information and Broadcasting Minister and Senior BJP leader Prakash Javadekar has said, it is clear that Maha Vikas Aghadi is actually Maha Vasooli Aghadi and its common minimum programme is to collect money through police. Javadekar said Shiv Sena wanted to suppress the truth that's why it supported Vaze earlier. He said, Maha Vikas Aghadi has no moral right to remain in power.
