The Madras High Court on Friday directed the Central Board of Film Certification (CBFC) to issue a U/A certificate to actor Vijay-starrer Jana Nayagan forthwith, observing that entertaining such complaints would give rise to a “dangerous trend”.Justice P.T. Asha allowed the release of the film after setting aside the CBFC’s decision to refer it to the Revising Committee following a complaint raised by one of its members. The court held that the move was without jurisdiction and came after the certification process had already reached its conclusion.“After examining the materials, it is crystal clear that the complainant’s grievance appears to be an afterthought,” the court observed, adding that entertaining such complaints would pave the way for a “dangerous trend”.
The High Court further noted that the exercise of power by the CBFC chairperson was improper. “The exercise of power by the chairperson is without jurisdiction since the power of the chairperson to send for review stood abdicated after he, on behalf of the committee, informed that a U/A certificate would be granted subject to incisions,” Justice Asha said.
According to information, the court clarified that the certificate would “automatically follow once the modifications are carried out” as recommended by the committee.Jana Nayagan, touted to be Vijay’s final film before his anticipated entry into active politics, was submitted to the CBFC on December 18. The makers were asked to carry out 27 cuts, which were duly implemented before the film was resubmitted. However, despite complying with the directives, the certification was not issued.Amid the delay, producer KVN Productions announced late on Wednesday night that the film’s release had been postponed. The movie was originally slated to hit theatres on Friday, January 9.With the High Court now ruling in favour of the makers and directing the CBFC to issue the U/A certificate immediately, the path has been cleared for the film’s release. However, it remains to be seen when Jana Nayagan will finally arrive in theatres.
