The Lucknow Bench of the High Court has directed the Uttar Pradesh Police to register an FIR against Lok Sabha Lop Rahul Gandhi in an alleged dual citizenship case. The order was passed by Justice Subhash Vidhyarthi, directing police to investigate the matter further. The petition was filed by S Vignesh Shishir, a BJP worker from Karnataka, who challenged a January 28 order of the Special MP/MLA Court in Lucknow that had dismissed his plea for an FIR against Gandhi. Shishir claimed to possess documents and "confidential emails" from the UK government indicating that Gandhi is also a British national. In a post on X, Shishir thanked the high court and described the judgment as “landmark” and “historic.”

The BJP worker added that the Uttar Pradesh government has urged the HC to allow it to transfer the probe to the Central Bureau of Investigation (CBI). Shishir also requested the Centre to upgrade his Central Reserve Police Force (CRPF) security cover to the highest possible level across India with immediate effect. The Constitution of India does not permit dual citizenship. The complaint was initially filed before a special MP/MLA court in Rae Bareli. On December 17, 2025, the high court transferred the case to Lucknow. The petitioner subsequently moved the high court after his plea was dismissed by the Lucknow court.
