The Supreme Court on Friday refused to entertain plea of Jan Suraaj Party challenging 2025 Bihar Assembly elections. The top court said it cannot issue omnibus direction to set aside entire Bihar Assembly election, that too at instance of political party. SC asks Prashant Kishor-led Jan Suraaj Party to move Patna High Court with its grievances. “We can’t issue notice like this. There is a procedure. It is just a composite election petition. Because you lost elections you say set-aside the entire election result. What is this view of political party who has lost everything in the election then you want to come here," a bench led by CJI Surya Kant and Justice Joymalya Bagchi said.
In the petition filed under Article 32 of the Constitution, the party particularly challenged direct transfers of Rs.10,000 to women voters in the state while the Model Code of Conduct was in force. At the outset, Justice Bagchi asked under which clause of Section 100 of the Representation of the Peoples Act can an entire election be set aside.CJI Kant added that there have to be specific allegations with respect to each candidate regarding corrupt election practice, and said that the appropriate remedy is to file election petitions regarding each constituency.CJI Kant commented, "How many votes your party got? If people reject, then you approach the judicial forum to get popularity."
