India strengthens law to combat 'Paper Leaks', exam fraud

The Public Examinations (Prevention of Unfair Means) Amendment Bill, 2026 has been introduced in the Lok Sabha to strengthen India's legal framework against paper leaks, organised exam fraud and other unfair practices in public examinations. The proposed legislation seeks to build on the Public Examinations (Prevention of Unfair Means) Act, 2024, with tougher punishments, faster investigations and time-bound trials to safeguard the interests of millions of students appearing for government recruitment and entrance examinations.
Key Provisions of the Amendment Bill
The Bill significantly enhances penalties for those involved in examination fraud. Individuals found guilty could face imprisonment of five to 10 years and fines of up to Rs50 lakh, compared to the existing provision of three to five years' imprisonment and fines of up to Rs10 lakh. Organised exam-fraud syndicates would attract seven to 10 years' imprisonment along with a minimum fine of Rs10 crore, up from the earlier minimum fine of Rs1 crore.
The proposed amendments also impose stricter penalties on service providers and senior management found complicit in malpractice. Service providers could face fines of up to Rs5 crore and an eight-year ban from conducting public examinations, while directors and senior officials may face imprisonment of five to 10 years and fines of Rs5 crore.
Faster Investigation and Dedicated Courts
To ensure quicker action against offenders, the Bill empowers the Central Government to constitute Special Task Forces for investigating exam fraud cases. It also mandates that investigations by police, central agencies or special task forces be completed within two months from the registration or transfer of a case.A major feature of the legislation is the creation of Special Fast Track Courts in every State and Union Territory. These courts will conduct day-to-day hearings and aim to complete trials within three months of filing the chargesheet. Pending cases under the Act will also be transferred to these courts for speedy disposal. Dedicated Special Public Prosecutors will be appointed to handle such cases.
Time-Bound Appeals to Speed Up Justice
The Bill further introduces a time-bound appeal mechanism, allowing appeals against judgments of Special Fast Track Courts to be heard by a Division Bench of the High Court. Appeals must generally be filed within 30 days, with a maximum limit of 90 days, while High Courts are expected to dispose of appeals within three months of admission.The government said the amendments are aimed at protecting the credibility of public examinations by ensuring swift investigation, speedy justice and stronger deterrence against paper leaks and organised cheating. The proposed law seeks to reinforce transparency and restore confidence in India's examination system for students competing for educational and employment opportunities.
