Congress Leader Rahul Gandhi is convicted by a Surat Court in a 2019 criminal defamation case over his remarks about PM Narendra Modi’s surname. The court sentenced him two years jail. However, he was granted bail and his sentence was suspended for 30 days to allow him appeal in higher court against the verdict. Now the question is “Can Rahul Gandhi be disqualified from the Lok Sabha? The Representation of the People Act says that any member convicted and sentenced to jail for two years or more, will be disqualified. The person is disqualified for the period of imprisonment and a further six years. But there is an exception for sitting members provided in the Act. They have been provided a period of three months from the date of conviction to appeal and the disqualification will not be applicable until a decision comes on his appeal.
The case was filed against Gandhi by BJP MLA and former Gujarat minister Prunes Modi. In his complaint, BJP MLA had alleged that Mr Gandhi, while addressing the poll rally in 2019 Lok Sabha elections, defamed the entire Modi community. Wayanad MP Rahul Gandhi had made the remarks in a rally at Kolar in Karnataka, targeting PM Modi over his last name which he shares with fugitive businessmen Nirav Modi and Lalit Modi. The conviction of Rahul Gandhi in the defamation case highlights the importance of responsible public discourse and the need for political leaders to be mindful of their words and actions. Defamation cases have become increasingly common in Indian politics, with leaders from different parties often using harsh language and making personal attacks against each other. However, such language and behaviour only serve to further polarize the public and weaken the democratic process.
