FSSAI issues notices to Nestlé, Zydus Wellness over product claims

Food regulator FSSAI has issued notices to Nestle India and Zydus Wellness over "misleading claims" in certain products and has asked the companies to provide scientific proof to support their advertisements. In a social media post, the Food Safety and Standards Authority of India (FSSAI) said it has issued notices to Nestle India for misleading claims and non-compliant promotions involving two food products, 'Lactogen Pro 1 Powder' and 'Nan Excella Pro Stage 1'.
In the case of Lactogen Pro 1 Powder, FSSAI flagged the claim that the product "contains Whey Protein, which is a part of milk protein that is easy to digest". The regulator has asked Nestlé India to provide scientific evidence to support the claim and submit the necessary documents within the stipulated period.FSSAI also raised concerns over a claim on Nan Excella Pro Stage 1 that "5 HMOs helps support normal immune system". According to the regulator, the claim implied that the product was suitable for supporting the immune system.
The regulator said the claim did not comply with provisions that restrict claims related to the prevention, alleviation, treatment or cure of diseases, disorders or specific physiological conditions, unless expressly permitted under applicable regulations.Nestlé India has been asked to explain why action should not be initiated against it under the Food Safety and Standards Act, 2006. Nestlé India in an email response to Mint said that they have already submitted their response to FSSAI.
The regulator also issued a notice to Zydus Wellness Products Ltd citing misleading claims and advertisement on its food product Complan. For Zydus Wellness' Complan, the regulator flagged claims including “2X Faster Growth”, “Supports Concentration and Memory” and “Pro Immunity+ 34 Vital Nutrients”, displayed alongside images of two children on the product label.
FSSAI said the claims violated the Food Safety and Standards (Advertising and Claims) Regulations, 2018. It also flagged the advertisement claim “growth comes in 4 flavors” as violating the regulations.
The regulator has directed Zydus Wellness to provide scientific justification for the claims and show cause within the stipulated period as to why action should not be taken against the company.
